KSTP-TV - PIGSKIN PICKEM SWEEPSTAKES
OFFICIAL RULES
1. HOW TO ENTER: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. In order to enter, log on to the www.kstp.com website (“Website”) and click on keyword "Pigskin Pickem" and complete the free on-line registration form. This Sweepstakes will run from 11:59:59 PM Central Time (“CT”) on September 7, 2009, through 12:00:01 AM CT on February 8, 2010 (“Sweepstakes Period”). KSTP-TV is not responsible for problems accessing the Website, technical or atmospheric conditions that disrupt the completion of the registration or Sweepstakes play, or any other problems which might or might not result from this Sweepstakes. Limit one registration per person; any person submitting more than one registration may be disqualified.
2. HOW TO PLAY/HOW THE WINNER IS CHOSEN. Once you have registered on the Website, each Week throughout the Sweepstakes Period, click on the “Play Game” link to make your Weekly picks by following the on-screen instructions and predicting the winning team in each of the games played during that Week and predicting the score for the designated tie-breaker game for the Week. For purposes of this Sweepstakes, a Week shall mean all regular season professional football games played Thursday through Monday of any given week. To see the schedule of the dates and times for each game in any given Week, click on the “Schedule” page on the Website. Only one entry per contestant/email address is allowed. Once you have made your Weekly picks, confirm your picks by clicking on the “Submit” button at the bottom of the “Enter/Change Picks” page. YOU MUST ENTER YOUR PICKS EACH WEEK IN ORDER TO BE ELIGIBLE FOR THAT WEEK’S PRIZE.
a. Weekly Deadlines. All Weekly picks must be submitted no later than one hour prior to the start time of the first game to be played in that Week (“Weekly Deadline”) in order to be eligible for that Week’s prize. The Weekly Deadline is posted on the “Enter/Change Picks” page on the Website each Week. The complete list of Weekly Deadlines is also displayed on the “Schedule” page within the Website. A contestant may change his/her pick at any time during any given Week, so long as such change occurs before the Weekly Deadline. No submissions will be accepted after the Weekly Deadline for any reason. Sponsor’s web administrator’s computer will act as the official time clock for this Sweepstakes.
b. Weekly Winners. Each Week, contestant’s are credited with one point for correctly picking the winning team in each of the games played during any given Week. By way of example, if you choose team A to beat team B in the Thursday night game, and team A wins, you receive one point for correctly predicting the winning team. The contestant with the highest points at the end of that Week will be deemed the Weekly winner.
c. Weekly Tie-Breakers. In addition to predicting the winning team in each of the games played during any given Week, contestants will also predict the score for the designated tie-breaker game for that week. The U Pickem computer program then takes all the contestants who are tied for most points for the week and: (1) Subtracts what the fan chose as the score for the winning team from the actual winning team's score and squares this value; (2) Subtracts what the fan chose as the score for the losing team from the actual losing team's score and squares this value; (3) Adds 1 and 2 above together to get the fan's "score approximation;" and (4) the fan with the lowest "approximation" wins. If there is still a tie, the computer program then will choose a random winner from those contestants who are tied.
d. Grand Prize Winner/Tie-Breaker. At the end of the Sweepstakes Period, Sponsor will tally up the points earned by each contestant throughout the entire Sweepstakes Period. The Grand Prize winner will be the contestant with the highest number of points earned throughout the entire Sweepstakes Period. In the event of a tie, The U Pickem computer program then takes all the contestants who are tied for most points for the season and looks at the final week's tie breaker game and: (1) Subtracts what the contestant chose as the score for the winning team from the actual winning team's score and squares this value; (2) Subtracts what the contestant chose as the score for the losing team from the actual losing team's score and squares this value; (3) Adds 1 and 2 above together to get the contestant's "score approximation;" and (4) the fan with the lowest "score approximation" wins. If there is still a tie, the computer program then looks back at the previous week's tie breaker "score approximation." If there is still a tie, the computer program goes back each week until the tie is broken. If there is still a tie after going back through all the weeks, the computer program chooses a random winner from those contestants who are tied.
There will be a total of seventeen (17) Weekly winners, and one (1) Grand Prize winner. Each winner will be notified by telephone/mail/email.
3. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”):
a. Seventeen (17) Weekly Prizes (one (1) Weekly Prize will be awarded per Week) – Each weekly winner will receive three (3) certificates from SportClips Haircuts; each certificate is redeemable for one (1) adult haircut; value: $48. Certificates must be used by January 31, 2010.
b. One (1) Grand Prize. One (1) 47” Toshiba Regza HD LCD Big Screen Television (Model #: 47ZV650). ARV: $1,700.00.
Total ARV of all prizes is $2,516. The prizes are not exchangeable, nor can they exchanged for cash or credit. Any warranties and guarantees are strictly limited to the manufacturer’s. Gift certificates are subject to certificate’s standard terms, conditions and restrictions as printed on the certificate. A qualified winner must also meet the eligibility requirements as set forth in Paragraph 5 of these Official Rules. All income taxes and other taxes, fees or costs are the responsibility of the winner. A 1099 form may be submitted to all appropriate taxing authorities.
Odds of winning a Weekly prize are dependent on the number of eligible entries received each week. The odds of winning the Grand Prize are dependent on the number of eligible entries received throughout the Sweepstake's Period.
4. CLAIMING YOUR PRIZE: Each winner must claim his/her prize in person at the KSTP-TV Studios, 3415 University Avenue, St. Paul, Minnesota 55114, during normal business hours (Monday-Friday, 9:00 a.m. to 5:00 p.m.) during normal business hours (Monday-Friday, 9:00 a.m. to 5:00 p.m.) within ten (10) days after the day he or she wins. This is to verify that the prize is being given to the qualified winner. Failure to comply with this deadline shall be deemed to be the winner’s forfeiture of his/her right to claim the prize. Each winner must prove he/she is a qualified winner by presenting identification acceptable to KSTP-TV (e.g., state drivers license; state issued identification card; valid passport with address verification; or birth certificate with social security card and photo identification and address verification). If a winner cannot prove he/she is a qualified winner, the prize will not be awarded. All unclaimed prizes remain the property of KSTP-TV. Prizes will not be issued to winners unless a social security number is presented. If a weekly winner is unable to come to the KSTP-TV Studios to claim his/her prize, the winner may make arrangements with KSTP-TV to have his/her weekly prize mailed to his/her home; KSTP-TV is not responsible for problems resulting from the mailing of the prize to a winner’s home.
5. ELIGIBILITY: Individuals must be legal residents of Minnesota or Wisconsin, and 18 years of age or older at the time of registration to be eligible to enter and win. Void where prohibited. Employees of KSTP-TV, LLC (“Sponsor”), Hubbard Broadcasting, Inc., SportsClips and participating partners, including their subsidiaries, affiliates, parent or related companies, and their immediate family members or those living in the same household (whether related or not), are not eligible to enter or win. Anyone participating in this Sweepstakes, or claiming a prize in this Sweepstakes in violation of these Official Rules will be disqualified from participating in KSTP-TV contests/sweepstakes for a period of one (1) year.
6. RELEASE; CONSENT TO USE LIKENESS, VOICE AND ADDRESS: The winners must execute an Affidavit of Eligibility. Contestants hereby agree to release and indemnify KSTP-TV, LLC, Hubbard Broadcasting, Inc., SportClips, and the participating partners (including their officers, directors, employees and subsidiaries, affiliates, parent or related companies) from and against any and all liability, claims, damages and actions arising directly or indirectly out of or sustained in connection with the awarding, acceptance or use of the prize(s) or participation in this Sweepstakes. Further, winners (a) agree that no Sponsor or agents have made any representation, warranty or guaranty relative to the prize, and (b) consent to the use by the Sponsor of this Sweepstakes for promotional purposes only of his/her likeness and/or voice and address (city and state) and his or her Sweepstakes participation (which will be posted on the Website), without any additional compensation or prior approval rights. By accepting the prize, the winners agree to be bound by these Official Rules, including the above release.
7. WINNER LIST: For the names of the winners, send a separate self-addressed, stamped envelope before March 15, 2010, to Winners List, Pigskin Pickem Sweepstakes, KSTP-TV, 3415 University Avenue, St. Paul, Minnesota 55114.
8. MISCELLANEOUS:
Sponsor, and its respective agencies are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed telephone or computer hardware or software or other technical failures, unauthorized human intervention, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation, the incorrect or inaccurate capture of entry information regardless of cause. Once submitted, entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, programmed or like entry methods will void all entries affected by such methods and be deemed tampering. Entry material/data that has been tampered with or altered is void. In the event of a dispute concerning who submitted an email entry, the entry will be declared to have been made by the authorized account holder of the email address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an email address by an internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND IF SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
Decisions of the Sponsor concerning any and all matters with respect to this Sweepstakes shall be final and binding in all matters. All federal, state and local laws and regulations apply. The Sponsor reserves the right to change these Official Rules, as well as the terms and conditions of this Sweepstakes, without notice. If the Sponsor determines in its sole discretion that the integrity or fairness of this Sweepstakes has been corrupted in any manner, the Sponsor reserves the right to terminate the Sweepstakes and to select a winner from among entries legitimately received prior to termination based on the judging criteria set forth in rule #2 of these Official Rules. The Sponsor reserves the right to change the prize values at any time, or to substitute prizes of comparable value. Sweepstakes void where prohibited or otherwise restricted by law. The Sponsors is not responsible for printing errors in the Sweepstakes materials or these Official Rules.
